  • Landlord News:

    Energy Performance Certificates are now compulsory when a new tenancy is signed and the property does not already have a certificate. In the Bath/Bristol area, Edison Ford recommends the Energy Efficiency Company Bath, Energy Assessors who can provide the necessary certificate at a competitive price. If you are elsewhere in the country you can find your nearest Energy Assessor by clicking here.

    Owners of HMOs need to prove they have some professional experience and or qualifications in order for some local authorities to grant them a certificate. If you feel like training yourself to become a better landlord, go to www.landlorddevelopment.org.uk
  • Local Housing Allowance was introduced on 7 April 2008. Any new tenancies from that date onwards where the tenant is eligible to claim benefit will fall under the new system. The biggest change for landlords is that benefit is payable to the tenant, not the landlord. The method of calculating benefit also changed significantly. In some areas the level of payment has increased, the system is based on an averaging of rents throughout an area. The county of BANES appears to have seen an increase due to the high rents found in Bath. For example a person renting a one bed flat may now claim £595 per month.   • Tenancy Deposit Protection Schemes were introduced on 6th April 2007. If you are a landlord and take deposits from your tenants (wise) you are affected. The penalties for not complying are harsh, so you need to be aware. There are two types of scheme: a single custodial scheme (where deposits are paid into and held in a separate account managed by the scheme); and two insurance-based schemes where the landlord or agent holds the deposit and any failure on his/her part to repay it to the tenant is covered by the scheme's insurance arrangements.

    Statutory tenancy deposit schemes apply to all ASTs (assured short hold tenancies), where a deposit has been taken after April 6 2007, in England and Wales. They do not apply in Scotland or Northern Ireland.

    The custodial scheme run by The Deposit Protection Service (The DPS) is free to use for tenants and landlords. The scheme is funded by the surplus from interest generated on the pool of deposits, with interest also being paid to the tenants. If a dispute arises between the landlord and the tenant at the end of the tenancy the scheme will hold the amount until the dispute resolution service or courts decide what is fair.

    The insurance-based schemes are funded through a fee paid by landlords or agents . The service is free to tenants, though most landlords pass on the cost. See www.mydeposits.co.uk  or www.thedisputeservice.co.uk  for full details.
